Conditional Cannabis Retailer License

The New York State Cannabis Control Board proposed to issue a first round of over 100 adult-use cannabis retailer licenses to justice involved applicants, namely, individuals with prior cannabis convictions, or whose family members have previously been harmed by criminalization.

To qualify for a conditional cannabis retailer license, an applicant needs to:

  • Have been convicted of a cannabis-related offense prior to March 31, 2021 or
  • Have had a parent, legal guardian, child, spouse, or dependent face a cannabis-related conviction prior to March 31, 2021. 

To apply for a conditional cannabis retailer license for their business, an eligible applicant (conforming with the aforementioned requirements) must have had at least 10% ownership in and control of the qualifying business for at least two (2) years.

Non-profit organizations may also be eligible for the conditional license if they intentionally serve justice involved individuals and communities historically impacted by cannabis criminalization. 

Duration of conditional cannabis retailer license: 

  • The conditional license would be valid for four (4) years.
  • Licensees who want to transition to a standard adult-use retailer license would need to notify regulators of their intent to continue to participate in the recreational market within 120 calendar days of the expiration of their conditional license. 

The application period is expected to open summer of 2022, with licenses being distributed by fall of 2022.
